Article 1 — Seller identification

Ammar Osei-Mohamend

Individual entrepreneur (micro-entrepreneur)

SIRET: 99931654000015

Registered office: 8 bis rue Abel, 75012 Paris

Telephone: 07 64 37 09 17

Sales email: contact@molleva.fr

Article 2 — Purpose and scope

These General Terms and Conditions of Sale (the “Terms of Sale”) govern the sale of a Premium subscription to the Molleva mobile application (the “App”), when the App and the Premium offer are available in the store corresponding to the platform being used.

As of the date these Terms of Sale were updated, the App is officially available on Android through Google Play. No iOS version is currently confirmed as available; the provisions relating to the App Store will apply only if such a version is made available.

They apply to every purchase made by an individual consumer acting for purposes outside their trade, business, craft or profession (the “Customer”). Every purchase constitutes unconditional acceptance of these Terms of Sale and the General Terms and Conditions of Use (the “Terms of Use”).

These Terms of Sale are governed by French law and the mandatory provisions of the French Consumer Code. If the Customer resides in another Member State of the European Union, the mandatory consumer-protection provisions of their country of residence also apply where they are more favourable to the Customer.

Article 3 — Pre-contractual information

In accordance with Article L221-5 of the French Consumer Code, the Customer is informed of the following before subscribing:

a) Essential characteristics of the service: The Premium subscription gives access to advanced features of the Molleva app, as detailed in Article 4. It is a paid digital service provided on a subscription basis.

b) Price: Prices are set out in Article 5, inclusive of all taxes.

c) Payment terms: For the Android version currently available, payment is made exclusively through the Google Play Store. Payment through the Apple App Store will apply only if an iOS version is made available.

d) Date or period of supply: Access to Premium features is activated immediately after the relevant platform confirms payment.

e) Seller’s identity: See Article 1.

f) Customer service contact details: contact@molleva.fr

g) Right of withdrawal: Under Article 9 of these Terms of Sale, the Customer has a 14-day right of withdrawal. The model withdrawal form is included in the Annex to these Terms of Sale.

h) Cost of communications: No additional charge is incurred in entering into the contract.

i) Contract term and cancellation terms: The subscription renews automatically. Cancellation terms are set out in Article 8.

j) Features of the digital content: See Article 4.

k) Technical protection measures (DRM): Access to the service requires authentication through a Molleva account. No other digital rights management measure is applied.

l) Compatibility and interoperability:

Required hardware and software environments:

PlatformMinimum version
iOS / iPadOS15.1 or later, if an iOS version is made available
Android7.0 (API 24) or later — version currently available

The App requires an internet connection to synchronise data and use AI-assisted features. Voice recognition and reading text from images run on the device, without transmitting the audio or image.

Customer data can be exported from the App (Profile → Export my data) in JSON format, an open standard readable by any data-processing software. No technical lock-in prevents the data from being reused outside the App.

m) Legal guarantee of conformity: The Customer benefits from the legal guarantee of conformity applicable to digital services, under the conditions set out in Article 12.

n) Updates: The terms and period for providing updates are set out in Article 13.

Article 4 — Premium offers and features

4.1 Free version

The free version of the App remains fully functional. The core service features — daily priorities, conscious postponement, text brain dump, check-in and low-energy mode, small wins and basic task breakdown — are available without a subscription.

The free version provides access to the last 14 days of history.

Voice capture and reading text from a photo also have limited free discovery access.

4.2 Features included in the Premium subscription

In addition to the free features, a Premium subscription gives access to the following thirteen features:

A helping hand

  • Sort your recent captures — assisted organisation of captured items
  • Enriched task breakdown — alternatives and more context to refine smaller steps. Basic task breakdown remains free.
  • Detect a date — find a date in an item; review the suggestion and choose whether to schedule a local reminder
  • Clarify your tasks — assisted rewording
  • Paste a long text — import and structure pasted text
  • Avoid duplicates — flag items similar to one already in your list
  • Enriched voice capture — suggest an order for dictated items after transcription, for you to review and confirm.

Features that use artificial intelligence are subject to usage quotas designed to prevent abuse. These quotas are significantly higher for Subscribers than for free-version users. They are not displayed during use; when a limit is reached, the App tells you when the feature will become available again.

In your space

  • Search the past — search your history
  • Focus on one thing — a display mode centred on a single priority
  • Full monthly recap — read and export the complete monthly recap.
  • Create your own cues — personalised daily cues
  • Two more moods — additional display themes
  • Your full history — access to your entire history, with no time limit

4.3 Changes to features

The features included in the subscription may change over time. If a substantial feature included in the subscription is removed, the Customer will be informed at least 30 days in advance and may cancel without charge if the removal significantly affects the value of the service subscribed to.

The terms applicable to service updates are set out in Article 13.

Article 5 — Prices

PlanTermBillingPrice incl. VAT
Monthly1 month, renewableMonthly€4.99 / month
Annual12 months, renewableAnnually€49.99 / year (i.e. €4.17 / month)

Prices include all taxes. For the version currently available, sales are made through Google Play, which collects and remits the applicable VAT. If the iOS version is made available, the corresponding sales will be made through the Apple App Store under its terms.

No other plan is offered: there is no lifetime offer, student price or free trial period.

Article 6 — Subscription process

6.1 Distribution platforms

The subscription is purchased exclusively through the store available for the platform being used:

  • Google Play Store (Android): subscriptions, payments, billing and refunds are managed by Google LLC. This platform is currently available.
  • Apple App Store (iOS): subscriptions, payments, billing and refunds will be managed by Apple Distribution International Ltd. if an iOS version is made available.

6.2 Order process

  1. The Customer selects a Premium plan in the App (Profile → Premium).
  2. The Customer confirms the subscription through the interface of the available store (Google Play at present; the Apple App Store once the iOS version is made available).
  3. After the relevant platform confirms and processes payment, Premium features are automatically activated on the Customer’s Molleva account.

6.3 Confirmation

The relevant platform sends a subscription confirmation. Premium features are activated within a maximum of 5 minutes after confirmation.

6.4 Payment data

Ammar Osei-Mohamend never has access to the Customer’s bank or payment details. Those details are processed exclusively by the platform used. The payment methods accepted are those offered by that platform.

6.5 Billing

Invoices are issued by the platform used and are available in the corresponding account area. For the Android version currently available, this is Google Play; if the iOS version is made available, it will be the Apple App Store. On request, Ammar Osei-Mohamend can provide an additional certificate at contact@molleva.fr.

Article 7 — Automatic renewal

7.1 Principle

The monthly or annual subscription renews automatically at the end of each billing period at the then-current price, unless cancelled in advance under the conditions set out in Article 8.

7.2 Renewal notice

Apple and Google notify the Customer before each renewal in accordance with their respective policies. If an email address is available, Ammar Osei-Mohamend may also send a reminder 7 days before the renewal date.

7.3 Price changes before renewal

Any price increase will be notified to the Customer at least 30 days before the next renewal date, by a notice in the App and, if possible, by email. A Customer who does not accept the new price may cancel their subscription before the renewal date without charge.

7.4 Reproduction of the statutory provisions on tacit renewal

Pursuant to Article L215-4 of the French Consumer Code, Articles L215-1 to L215-3 and L241-3 of that Code are reproduced in full below.

Article L215-1 of the French Consumer Code

For service contracts entered into for a fixed term and containing a tacit-renewal clause, the service provider must inform the consumer in writing, by a dedicated personalised letter or email, no earlier than three months and no later than one month before the end of the period during which renewal may be refused, that the consumer may choose not to renew the contract entered into with a tacit-renewal clause.

If the consumer has not been sent that information in accordance with the first paragraph, the consumer may terminate the contract free of charge at any time from the renewal date.

In that case, any advance payments made after the last renewal date or, for open-ended contracts, after the date on which the original fixed-term contract became open-ended, will be refunded within thirty days of the termination date, less the amounts corresponding to performance of the contract up to that date.

This Article applies without prejudice to provisions that legally subject certain contracts to specific rules concerning consumer information.

By way of exception to the first paragraph of this Article, for contracts for the provision of television services within the meaning of Article 2 of Law No. 86-1067 of 30 September 1986 on freedom of communication and for contracts for the provision of on-demand audiovisual media services, the consumer may terminate the contract free of charge at any time from the first renewal if they move home or their tax household changes.

Article L215-1-1 of the French Consumer Code

Where a contract was entered into electronically, or by another means and the professional offers the consumer the possibility of entering into contracts electronically on the date the consumer terminates the contract, termination must also be possible by that means.

For this purpose, the professional must make available to the consumer a free feature enabling them to submit the termination notice and complete the necessary steps electronically. When the consumer gives notice of termination, the professional confirms receipt of the notice and informs the consumer, on a durable medium and within a reasonable time, of the date on which the contract ends and the effects of the termination.

A decree sets out, in particular, the technical requirements for ensuring the consumer’s identification and easy, direct and permanent access to the feature referred to in the second paragraph, including how it is presented and used. It specifies the information the consumer must provide.

Article L215-2 of the French Consumer Code

The provisions of this Chapter, except for Article L. 215-1-1, do not apply to operators of drinking-water supply and sanitation services.

Article L215-3 of the French Consumer Code

The provisions of this Chapter also apply to contracts between professionals and non-professionals.

Article L241-3 of the French Consumer Code

If the professional has not made the refund under the conditions provided for in Article L. 215-1, the amounts due bear interest at the statutory rate.

Implementation of Article L215-1-1: because the subscription was purchased electronically through the store used (Google Play at present; the Apple App Store once the iOS version is made available), cancellation is completed electronically in the relevant store interface, in accordance with Article 8.1. This method is free, permanently accessible and does not require any action with the publisher.

Article 8 — Cancellation

8.1 Cancellation by the Customer

The Customer may cancel their subscription at any time via:

  • Android (platform currently available): Play Store → Profile → Payments and subscriptions → Subscriptions → Molleva → Cancel
  • iOS (once the iOS version is available): Settings → [Your name] → Subscriptions → Molleva → Cancel Subscription

Cancellation takes effect at the end of the current period. The Customer retains access to Premium features until the end of the paid period. No pro-rated refund is granted for the unused period, except in the cases set out in Article 10.

8.2 Important — account deletion and subscription

⚠️ Deleting the Molleva account (Profile → Delete my account) does not automatically cancel the subscription with Apple or Google. The Customer must cancel separately in accordance with Article 8.1 to avoid any further charges.

8.3 Cancellation by the publisher — minor breach

If the Customer breaches the Terms of Use, Ammar Osei-Mohamend may suspend access to the service after giving formal notice that remains unremedied for 15 days. If the Customer has a Premium subscription, Ammar Osei-Mohamend will refund the unused period on a pro-rated basis.

8.4 Cancellation by the publisher — serious breach

In the event of a serious and clear breach of the Terms of Use (fraudulent use, attempted compromise of the service’s security, impersonation or unlawful use), Ammar Osei-Mohamend may suspend or terminate the account without notice. In that case, no refund is due for the remaining period. The following constitute serious breaches for the purposes of this Article:

  • any attempt to gain unauthorised access to the App’s systems;
  • any use of automated scripts or bots for abusive purposes;
  • any act of fraud, hacking or circumvention of security mechanisms;
  • any conduct intended to harm other users or the publisher.

8.5 Cancellation by the publisher — service closure

If Ammar Osei-Mohamend decides to permanently cease operating the App:

  • active Premium Customers will be informed at least 60 days in advance by a notice in the App and by email;
  • Ammar Osei-Mohamend will refund the unused period on a pro-rated basis for subscriptions in progress.

Article 9 — Right of withdrawal

9.1 Principle

In accordance with Articles L221-18 et seq. of the French Consumer Code, a consumer Customer has 14 calendar days from the day the contract is entered into to exercise their right of withdrawal, without having to give a reason and without penalty.

The Premium subscription is a service contract. The right of withdrawal remains available throughout the 14-day period: a one-month or one-year subscription cannot be considered fully performed within those 14 days. Using the service for all or part of the period therefore does not cause the Customer to lose their right to withdraw.

9.2 Express request for immediate performance

At the time of purchase, the Customer may expressly request that performance of the contract begin before the withdrawal period ends, so they can use the Premium features immediately. This request is collected by means of an unticked by default checkbox, and its timestamp is retained.

This request does not deprive the Customer of any rights. It has only one consequence: if the Customer withdraws, they owe an amount corresponding to what was actually supplied up to the date of withdrawal, proportionate to the period of use in relation to the total term of the contract (Article L221-25 of the French Consumer Code).

Amount due = Price incl. VAT × (days used ÷ total contract term in days)

Example: A Customer subscribes to the annual plan for €49.99, requests immediate performance, and then withdraws on day 5. Amount due = €49.99 × (5 ÷ 365) = €0.68. Amount refunded = €49.31.

9.3 No express request

If no express request for immediate performance was obtained, the Customer owes no amount if they withdraw. The refund is then for the full amount.

9.4 How to exercise the right of withdrawal

The Customer may exercise their right of withdrawal in any of the following ways:

Through Google (platform currently available): https://play.google.com/store/account/subscriptions

Through Apple (once the iOS version is available): https://reportaproblem.apple.com

Directly through Ammar Osei-Mohamend: by sending the attached withdrawal form to contact@molleva.fr or by post to 8 bis rue Abel, 75012 Paris.

Withdrawal may be communicated by any unequivocal means, including by using the model form in the Annex to these Terms of Sale.

9.5 Effects of withdrawal

If the withdrawal is valid, Ammar Osei-Mohamend or Apple/Google will issue the refund within 14 days of receiving the withdrawal request, using the same payment method as the one used for the subscription.

Article 10 — Refunds

10.1 Refunds through app stores

Refunds for purchases made through the store used are processed under that store’s policy:

  • Google (platform currently available): https://play.google.com/store/account/subscriptions
  • Apple (once the iOS version is available): https://reportaproblem.apple.com

10.2 Exceptional refunds granted by the publisher

Independently of the app-store policies, Ammar Osei-Mohamend may grant an exceptional refund in the following cases:

a) Prolonged service unavailability: if the service is unavailable due to an event attributable to Ammar Osei-Mohamend for more than 72 consecutive hours in the same calendar month, the Premium Customer may request store credit or a pro-rated refund by emailing contact@molleva.fr within 30 days of the incident.

b) Billing error: in the event of double billing or an obvious error in the amount charged, Ammar Osei-Mohamend will refund the overpayment in full within 14 business days.

c) Service non-conformity: if the service does not match the description in these Terms of Sale, the Customer may request that it be brought into conformity or request a refund under the legal guarantee of conformity (Article 12).

Article 11 — Service availability

Ammar Osei-Mohamend endeavours to keep the App available 99% of the time, excluding scheduled maintenance.

Interruptions may occur for:

  • scheduled maintenance (announced in advance in the App);
  • urgent security updates;
  • force majeure events (Article 1218 of the French Civil Code): natural disaster, act of war, pandemic, large-scale cyberattack or third-party infrastructure outage beyond our control.

These interruptions do not entitle the Customer to compensation unless they exceed the threshold set out in Article 10.2.a.

Article 12 — Legal guarantees

12.1 Legal guarantee of conformity for digital services

In accordance with Articles L224-25-12 et seq. of the French Consumer Code, transposing Directive (EU) 2019/770 on contracts for the supply of digital content and digital services, Ammar Osei-Mohamend guarantees that the Premium service conforms to its contractual description and to the conformity criteria provided for by those provisions.

Duration of the guarantee of conformity: As the Premium service is provided continuously, the guarantee of conformity applies throughout the period for which the service is to be supplied under the contract. Each subscription renewal starts a new supply period and therefore a new guarantee period.

If a lack of conformity is reported during that period, the Customer may request:

  1. that the service be brought into conformity within a reasonable time and free of charge;
  2. failing that, a price reduction or termination of the contract with a refund.

During the period for which the service is supplied, the professional bears the burden of proving that the digital service conforms.

To report a lack of conformity: contact@molleva.fr

12.2 Legal guarantee against hidden defects

Articles 1641 to 1649 of the French Civil Code apply. The Customer may bring a claim within 2 years from discovery of the defect.

Article 13 — Service updates

13.1 Purpose and reason for updates

The Customer agrees that the Premium service may be updated during the term of the contract. These updates are intended:

  • to maintain the App’s compatibility with changes to Android and, once that version is made available, iOS, as well as with the relevant devices;
  • to ensure the security of the service and protection of the Customer’s data;
  • to improve the service and correct defects.

13.2 Prior notice

The Customer will be informed of each update in advance, clearly and understandably, a reasonable time beforehand, on a durable medium (a notice in the App that can be retained, or an email).

This notice specifies the update date, what it changes and, where applicable, its consequences for access to or use of the service.

13.3 No additional cost

Updates are provided to the Customer at no additional cost. They do not change the subscription price or billing terms.

13.4 Right to refuse an update that is not necessary

The Customer may refuse an update that is not necessary to keep the service in conformity. Refusing such an update will not result in termination of the contract or suspension of access to the service; the Customer will continue to benefit from the earlier version, subject to the technical limitations of their device.

However, updates necessary to keep the service in conformity, including security patches, cannot be refused without exposing the Customer to a lack of conformity that would no longer be attributable to the publisher.

13.5 Update with a negative impact

If an update has a negative impact on the Customer’s access to or use of the digital service, the Customer may terminate the contract by operation of law, free of charge, within 30 days of the update or of the date on which they became aware of it, if that date is later.

This termination gives rise to a refund of the portion of the price corresponding to the period for which the service was not supplied.

The Customer may not exercise this right if the negative impact is minor.

13.6 Period for which updates are provided

Ammar Osei-Mohamend undertakes to provide updates necessary to keep the service in conformity, including security updates, throughout the Customer’s subscription period, including renewals.

For users of the free version, this undertaking applies throughout the period in which the App is operated.

Article 14 — Customer service

Telephone: 07 64 37 09 17

Response time: 3 business days

Hours: Monday to Friday, 9:00 a.m.–6:00 p.m. (Paris time)

Article 15 — Governing law and dispute resolution

These Terms of Sale are governed by French law.

In the event of a problem, the Customer is invited to contact customer service (Article 14) to seek an amicable solution.

If no amicable resolution is reached, the competent court will be the court for the consumer’s place of residence (Article R631-3 of the French Consumer Code) or, at the consumer’s choice, the court having jurisdiction under the ordinary rules.

Article 16 — Miscellaneous provisions

16.1 Entire agreement

These Terms of Sale, the Terms of Use and the Privacy Policy constitute the entire agreement between the parties concerning their subject matter.

16.2 Severability

If any provision of these Terms of Sale is held to be void or unenforceable, the remaining provisions will remain in force.

16.3 No waiver

Ammar Osei-Mohamend’s failure to rely on a breach by the Customer does not constitute a waiver of its right to rely on that breach later.

16.4 Changes to the Terms of Sale

These Terms of Sale may be changed at any time. In the event of a material change, the Customer will be informed at least 30 days in advance by a notice in the App and by email. If the Customer does not accept the new terms, they may cancel their subscription before the new Terms of Sale take effect, without charge.
